Legal implications of surrogacy

My partner and I cannot have a child naturally and want to consider surrogacy. What legal issues must I consider?

Surrogacy is the process by which a child is carried through pregnancy by a woman who has entered into an arrangement that the child and parental responsibility for it will be transferred to another person(s) at birth. Surrogacy arrangements are often attractive to heterosexual couples who are experiencing infertility, and same-sex couples.

Whilst surrogacy is legal in the UK, commercial surrogacy is not. No money or benefit must be given or received under the arrangement, other than for expenses.

One of the first issues to consider is whether to enter into a partial or total surrogacy arrangement. Partial surrogacy is the process whereby the surrogate mother is also the child’s biological mother. The child will be biologically related to the father (or sperm donor) and the surrogate mother.

In contrast, total surrogacy is where the woman carrying the child is not biologically related to the child. The embryo is carried by the surrogate and can be created from:

A genetic mother’s egg and genetic father’s (or donor’s) sperm.

A donor egg and genetic father’s sperm.

A donor egg and donor sperm.

Another important issue to consider is where to enter into the surrogacy arrangement. If you choose an international surrogate, it is vital that you seek specialist advice.

The surrogate mother (whether or not biologically related) is treated as the child’s legal mother until the court makes a court order in favour of the commissioning parents. The surrogate mother cannot simply surrender her parental responsibility. If the surrogate mother is married, the husband of the surrogate mother will be treated as the father of the child.

The permanent transfer of legal parenthood and parental responsibility to the commissioning parents can only be brought about by the making of an ‘adoption order’ or a ‘parental order’.

The application for a parental order must be made within six months of the child’s birth. The applicants must be aged at least 18 years old and either be married, in a civil partnership, or in an enduring family relationship (i.e. living together as a couple). Furthermore, at least one of the commissioning parents must have provided the genetic material used to create the embryo. Finally, the surrogate mother (and her husband, if applicable) must give free and unconditional agreement to the order being made.

For any couple, there’s nothing like the moment they realize that they’re going to become parents, whether it’s though pregnancy, surrogacy, or adoption. Nowadays, there are so many ways to become a parent, but it doesn’t take away from the joy of discovering thats a long-time wish is about to come true.

Many moms and dads often feel God’s call to adopt, even if they have biological children of their own, and several at that! That was the case of Jen Avellaneda and her husband, who already had four children and were looking to add to their family. They fostered several children, but all were adopted with a few months.

That’s when they felt the needto adopt a 3 1/2-month baby girl. Over the course of several months, they underwent the grueling adoption process. They already loved her as if she were their own.

Then doctors revealed the unthinkable after a year of tests: their little girl, whom they named Nicole, was growing deaf. There was a chance that she could become 100 percent deaf after a few years.

But that didn’t stop the Avellanedas from taking on the challenge. They made the stunning decision to go through with the process, and officially and legally make Nicole a part of their of their family. But when you see Nicole, nine years after her adoption, you’ll be amazed!

Artist Transforms Moms Expectant Bellies Into Beautiful Works Of Art

Bringing a new life into the world is always exciting for parents. Whether it’s their first child or another addition, a new baby is something to celebrate.

And one artist from Spain is helping women capture that joy in a beautiful and unique way.

Fatima Carrion Alfonso has worked as a body painter for over a decade, transforming human subjects into all kinds of incredible things, but she didn’t start working on pregnant canvases until she gave birth to her own daughter, Ainhoa, in 2015.

Since then, she’s been decorating moms-to-be with all kinds of images that capture their personalities, their wishes for their babies, and the special bond between mother and child.

Pregnancy photo shoots are all the rage, especially as more and more women are seeing pregnancy and motherhood as beautiful, empowering, and on their terms you know, how it should be! We’ve seen all kinds of crazy ideas, including expectant moms floating like magical mermaids underwater.

Fatima Carrion Alfonso is an artist, and has specialized in body painting for about 14 years.

But she didn’t think to use a pregnant belly as a canvas until she became a mom herself in 2015. After that, she wanted to extend her talents to other expecting moms.

She decided to offer her services to pregnant women in her area of Spain, where she lives, to give them something extra special for their maternity shoots.

So far, she’s painted 200 moms! And she has plenty more on the waiting list.

She works with the women to create a design that reflects their unique personalities and connections to their babies.

Many women, like the ones in the above photos, like images that capture the beauty of motherhood, family, and nature.

Others opt for a chance to show off their favorite things. It looks like this photo shoot had a whole Little Mermaid theme!

Still other women want something that reflects a more spiritual side of themselves and their role as mothers.

But of course, it’s all up to the mom.

“Every mother is different and has her own taste, hobby, and stories to tell,” Alfonso says.

And although she’ll paint a belly at any stage of pregnancy, she does suggest that the sixth to eighth month is the best time to become a painting.

Many women like to come in during their second or third month, though, and use the paintings as a form of birth announcements for their families and friends.

Alfonso also uses only water-based, non-toxic paints to keep both moms and babies safe and healthy.

Alfonso also says that the process of painting tends to relax most of the moms, which relaxes the babies in turn.

She also says that the babies often kick during the process, which is her favorite part of the process!

Deaf Baby Is Astonished When Shes Given The Gift Of Hearing

When youre a baby, hearing your mothers voice is one of the most soothing sounds for your soul. If you are a deaf baby, seeing your mothers face and feeling her touch is also just as powerful. Yet, how amazing would it be if it were possible to give your baby the gift of having all of his or her senses?

This incredible miracle happened for 3-month-old baby Annabelle Lawrence, who was born deaf but was given the gift of hearing when she was fitted with two hearing aids for the first time.

While Annabelle was given the gift of hearing, not all deaf children get the chance to hear, but weve seen them thrive, and its incredible to watch, such as the inspiringdeaf-blind baby who is off to a good start surrounded by her loving family.

In a heartfelt video that will bring you to tears, her mother Sarah Jo, from Boise, ID, asks her daughter if she can hear her voice and its the best reaction any parent would want from their child.

Her expression is priceless and her response to hearing a clapping sound for the first time brings out instincts she never had before.

To be able to tell Annabelle that I love her is very emotional, Sarah Jo explained to the U.K.s Daily Mail.

When Mom asks “Can you hear me?” the baby’sface answers that question in the cutest way possible!

For now, Annabelle’s hearing aids are temporary and enable her to hear sufficiently as the auditory nerve in her brain is functioning perfectly, the Daily Mail points out. For long-term hearing, she will have cochlear implants put in when she is 9months old.

The Most Popular Baby Names Of 2016 … So Far

Every summer, Nameberry releases a list of the popular baby names for the first half of the year. The rankings are based on which names attracted the most page views of nearly 40 million visits to Nameberry’s web site. The list gauges the baby names that are winning the most attention from parents-to-be right now, and may predict which names will be used most for babies in the future.

There’s a new girls’ name at the head of the baby names popularity list for the first half of 2016, with Olivia claiming Nameberry’s official number one spot. Ezra holds his place at the top of the boys’ popular names list, a position the Biblical name also claimed in 2015.

Olivia replaces Charlotte, the girls’ top name for 2015, which slips to number three. Amelia, Ava, and Isla round out the girls’ top 5. Five new girls’ names ascend to the top 10 in 2016: Arabella, Aurora, Adeline, Isabella, and Mia.

The top 5 boys’ names retain the order they claimed for 2015: Ezra, Asher, Atticus, Declan, and Oliver. Only two names are new to the boys’ top 10 in 2016: Levi and Wyatt.

Other hot baby names for boys — all up more than 40 places — are John, Tobias, Daniel, Xavier, and Maxwell. For girls, the “hottest” name so far this year is Sadie, which jumped up 48 places. Other girls’ names up more than 30 places in 2016 are Elise, Astrid, Isabella, and Thea.
